1. Who we are, and who makes these products
Caliber Sciences operates this site at calibersciences.com. In these Terms, "Caliber Sciences," "we," "us," and "our" mean that entity.
Caliber Sciences is a retailer. We do not manufacture the products we sell. Every product sold on calibersciences.com is manufactured by InstaMed Pharmaceuticals, an independent third party, and ships in InstaMed Pharmaceuticals' own packaging under its own branding. Caliber Sciences selects, markets, and resells InstaMed Pharmaceuticals' catalog directly to consumers; we do not alter, repackage, or relabel the product inside that packaging. InstaMed Pharmaceuticals' MAP Policy expressly authorizes reselling its products through a reseller's own company-owned e-commerce website, and calibersciences.com is that authorized channel. That authorization covers resale of the physical product only; it does not give Caliber Sciences any right to reuse InstaMed Pharmaceuticals' content, photography, or trademarks, which are governed separately (see Section 12).
These Terms of Sale govern every order placed on calibersciences.com. By placing an order, you agree to these Terms as they read at the time of your order. See Section 17 for how we handle changes to these Terms and how we keep a record of exactly what you agreed to.
2. Eligibility
You must be at least 18 years old to purchase from Caliber Sciences. Our site asks you to confirm your age before you can view product pages or place an order, and we rely on that confirmation. By placing an order, you represent that you are at least 18 years old and that you are purchasing for your own personal use, not for a minor.
At this time we ship only to addresses within the United States. See Section 6.
3. Accounts and order acceptance
You do not need an account to order, but if you create one, you are responsible for keeping your login credentials confidential and for all activity under your account.
Placing an order is an offer to buy, not a completed sale. We accept your order, and a contract is formed, when we ship your order or send you a shipping confirmation, whichever happens first, not when you submit your order or when your card is authorized.
We may refuse, limit, or cancel any order, at any time before shipment, for reasons including but not limited to: suspected fraud or unauthorized use of a payment method, inventory unavailability, a pricing or product-listing error, suspected resale or bulk diversion, a shipping restriction that applies to your address, or a violation of these Terms. If we cancel or reduce an order after your payment method has already been charged, we will refund the full amount charged for the cancelled portion, using the original payment method, without requiring you to take any action.
4. Pricing and taxes
All prices on calibersciences.com are listed in US dollars and do not include sales tax or any delivery fee required by law. We calculate applicable sales tax at checkout based on your delivery address, consistent with destination-based sourcing rules (Colorado and most other states tax a shipped sale at the delivery address, not our business address). Where required by Colorado law, a Colorado retail delivery fee will be itemized separately on Colorado orders delivered by motor vehicle.
If a product is listed at an incorrect price because of a typographical, pricing, supplier, or technical error, we may cancel any order placed at the incorrect price, whether or not the order has already been confirmed or charged, and will refund any amount already charged for that order. We will make reasonable efforts to notify you before cancelling for a pricing error.
5. Payment authorization and billing descriptor
By placing an order, you authorize us (or our payment processor, on our behalf) to charge your payment method for the full order total, including tax and any applicable delivery fee. You represent that you are authorized to use the payment method you provide.
Charges will appear on your card or bank statement under a descriptor identifying Caliber Sciences. If you do not recognize a charge, contact us first, using the information in Section 18, before disputing the charge with your bank or card issuer.
6. Shipping, delivery timing, and risk of loss
We currently ship only within the United States, by USPS or UPS, with tracking. Full processing and delivery timing detail, and what happens with a lost, damaged, or undeliverable package, is in our Shipping and Returns policy, which is part of these Terms.
Consistent with the FTC's Mail, Internet, or Telephone Order Merchandise Rule (16 C.F.R. Part 435), we will ship your order within the time we state at checkout or in your order confirmation, or, if we do not state a time, within 30 days of your order. If we cannot meet that timeframe, we will notify you and either obtain your consent to a delay or cancel the unshipped part of your order and refund you in full, without requiring you to ask.
Title and risk of loss for a product pass to you when the carrier delivers the package to the shipping address on your order. If your package is lost in transit, arrives damaged, or is marked delivered but never arrives, contact us using the information in our Shipping and Returns policy; we will work with you on a replacement or refund consistent with that policy, even though risk has technically passed to you at delivery.
7. Returns, refunds, and cancellations
We want returns and refunds to be easy, not something you have to fight for. The full process, including the return window, condition requirements, who pays return shipping, and how and when you get refunded, is in our Shipping and Returns policy, which is part of these Terms.
You may cancel an order for a full refund any time before it ships, by contacting us using the information in Section 18.
8. Supplement disclaimer and not medical advice
Caliber Sciences products are sold as dietary supplements. These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.
Caliber Sciences products are not represented as, and must not be understood as, a substitute for any prescription medication or compounded pharmaceutical product. We do not compare our products to, or position them as an alternative to, any prescription or compounded drug, and nothing on calibersciences.com should be read as making that comparison.
Nothing on calibersciences.com, in our marketing, or in these Terms is medical advice. We are a retailer, not a healthcare provider, and nothing we publish is intended to replace the advice of a physician or other qualified clinician. Do not use a Caliber Sciences product to diagnose or treat any medical condition, and do not stop or change any medication or treatment because of anything you read on our site, without talking to your own clinician first.
9. Consult your clinician
Talk to your doctor or another qualified healthcare provider before using any Caliber Sciences product, especially if you are pregnant, breastfeeding, under the care of a physician, taking prescription medication, or have any existing health condition. Individual results vary, and we do not guarantee that any product will produce any particular effect for you.

10. No resale, and quantity limits
Caliber Sciences products are sold to you for your own personal use, not for resale, redistribution, or commercial use. You may not buy Caliber Sciences products in order to resell them, in any channel, online or offline.
We may limit the quantity of any product a single customer or household may purchase, in a single order or within a rolling time period, and we may cancel or reduce an order that we reasonably believe is intended for resale or bulk diversion rather than personal use.
11. Acceptable use
When you use calibersciences.com, you agree not to: violate any law; provide false information at checkout or during age verification; attempt to bypass the age gate; use a stolen or unauthorized payment method; scrape, mine, or harvest data from the site with automated tools; interfere with the site's security, availability, or normal operation; or impersonate another person or entity. We may suspend or terminate your access to the site if you violate this section.
12. Intellectual property
The calibersciences.com site, including its design, text, graphics, and the "Caliber Sciences" name and logo, is owned by Caliber Sciences or its licensors. You may not copy, reproduce, or use any of it without our written permission, except as needed to place a normal order.
InstaMed Pharmaceuticals owns the InstaMed Pharmaceuticals name, its product names, and any trademarks, packaging design, and label content that appear on the products themselves. As noted in Section 1, InstaMed Pharmaceuticals' MAP Policy authorizes Caliber Sciences to resell its products through our own website, but InstaMed Pharmaceuticals' separate Terms and Conditions do not grant Caliber Sciences, and Caliber Sciences does not grant you, any right to reuse InstaMed Pharmaceuticals' content, photography, or trademarks beyond what is needed to identify and sell the genuine products we resell. Nothing in these Terms gives Caliber Sciences any ownership interest in InstaMed Pharmaceuticals' marks or intellectual property.
13. Disclaimer of warranties
Except as expressly stated in these Terms, products are sold on an as-is, as-available basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. Caliber Sciences does not manufacture the products it sells and makes no warranty regarding their manufacture, formulation, or performance; any manufacturer warranty is provided by InstaMed Pharmaceuticals, not by Caliber Sciences. Some states do not allow the exclusion of implied warranties, so this exclusion may not fully apply to you.
14. Limitation of liability
To the maximum extent permitted by law, Caliber Sciences's total liability to you for any claim arising from your order or these Terms will not exceed the amount you paid for the product giving rise to the claim. Caliber Sciences is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, even if we were advised of the possibility of those damages. Some states do not allow the limitation of incidental or consequential damages, so this limitation may not fully apply to you.
Nothing in this section limits any liability that cannot lawfully be limited, including liability for our own gross negligence, willful misconduct, or fraud, where applicable law does not permit that liability to be limited.
15. Indemnification
You agree to indemnify and hold Caliber Sciences, its owners, officers, and employees harmless from any claim, loss, liability, or expense, including reasonable attorney fees, arising from your breach of these Terms, your misuse of a product, or your violation of any law.
16. Dispute resolution, governing law, and venue
These Terms are governed by the laws of the state in which Caliber Sciences is organized, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your order that is not resolved informally must be brought in a court of competent jurisdiction, and you consent to personal jurisdiction in those courts.
17. Changes to these Terms
We may update these Terms from time to time. Each version is numbered and dated; this is version 2. When we publish a new version, it becomes effective for orders placed after that point.
We keep a record of exactly what you agreed to. When you accept these Terms at checkout, our system records the version number in force at that moment, the date and time, your IP address, and a cryptographic hash (SHA-256) of the exact text of the version you accepted. That hash is tied to your order, not to a pointer that could later resolve to a different, edited version of this file. A later update to these Terms, including this one, never changes what an earlier order shows you agreed to.
